- The karting tracks are run by the Organizer, which is KartCenter sp. z o.o., Stanisława Lema 4A/1, 80-126 Gdańsk NIP: 9571088613, which is the Personal Data Administrator, in accordance with the Privacy Policy.
- These Terms and Conditions define the terms and conditions of use by the Clients of the go-kart tracks run by the Organizer located at: Sopot, 3 Maja 69C, 81-850 and Gdańsk Schuberta 102A, 80-172, hereinafter referred to as go-kart tracks.
- The Organizer’s services are available to all interested parties, hereinafter referred to as Clients or Service Recipients, on the terms and conditions specified in these Terms and Conditions, agreements concluded with the Organizer.
- Before entering the track, customers or their guardians, subject to point 5 below, are required to read and comply with these Regulations. Registration in the Apex system confirms that they have read and complied with these Regulations. The Organizer will post the Regulations in a visible and accessible place for all potential Customers. Ignorance of the Regulations does not exempt them from compliance.
- A customer can be:
- a person who is over 18 years of age, who has full legal capacity,
- with the written consent of the statutory guardian – a person who does not have full legal capacity, who is over 16 years of age,
- a person who is over 7 years of age – using only rental go-karts, with the consent of the guardian,
- a person who is over 3 years of age – using only a KidRacer vehicle or a 2Drive go-kart and under the supervision of an adult.
- To use the go-kart tracks, it is necessary to purchase tickets at the ticket office or via Online Reservation and training. The current price list of Tickets and available discounts along with the rules of their use are contained in the price list published on the Organizer’s website and available at the ticket office of individual go-kart tracks of the Organizer.
- In special cases, the Organizer may deprive a person of a ride who violates the regulations or does not comply with the orders and instructions of the Organizer.
- Client The Organizer guarantees that he or she is not under the influence of alcohol, intoxicants, drugs, medications, or any other substances that may affect the driver’s reaction to the karting vehicle. He or she also guarantees that there are no other circumstances that could negatively impact driving behavior. The Organizer will refuse to allow a person to drive if it is suspected of failing to comply with these regulations. Any Client participating in a drive suspected of being under the influence of any of these substances will be immediately removed from the track without a refund. The Organizer reserves the right to perform a breathalyzer test on the Client, to which the Client consents.
- On the track area, Customers are obliged to strictly comply with the regulations, instructions and orders of the Organizer and its staff, signals, signal flags, as well as comply with all obligations related to preparation for driving and the direction of vehicle traffic.
- Participants are absolutely forbidden to get out of their vehicles during the ride (race).
- In the event of a vehicle stopping or its breakdown, assistance is provided by the designated employees of the Organizer’s track service.
- In addition, you should remember about properly fitted riding shoes. Customers in flip-flops or other types of loose footwear will not be allowed to ride.
- It is forbidden to hit other vehicles and hit the roads. If the Organizer finds such incidents, he may stop the race or immobilize the vehicle – in both cases without a refund for the unused driving time.
- The Client is also obliged to: ride in a protective helmet, start after the appropriate signal, stop immediately after signaling the end of the ride, exercise special caution, prohibition of driving in the opposite direction to the one set by the Organizer.
- The Client is obliged to inform the Organizer about any irregularities or failures and damages.
- Client The Client bears full civil and criminal liability for any personal and property damage caused by them while using the track, as well as for any damage to the Organizer’s premises, facilities, or equipment. Furthermore, the Client is obligated to use the Organizer’s premises, facilities, and equipment in a manner consistent with their intended use.
- The Organizer does not take responsibility for the consequences of accidents resulting from the Clients’ failure to comply with the regulations, orders and instructions of the Organizer’s staff. In addition, the Organizer is not obliged to substitute a new vehicle in place of the damaged one.
- In the facilities where the go-kart tracks are run, monitoring is installed in order to ensure the safety and protection of the property of the Customers, employees, associates and the operator of the Organizer’s facilities, as well as to determine and pursue claims or defend against claims. The administrator of personal data obtained in connection with the monitoring is KartCenter sp. z o.o., Stanisława Lema 4A/1, 80-126 Gdańsk NIP: 9571088613. Recordings are stored for a period of up to about 3 months, but the storage period also depends on the technical conditions resulting from the principle of overwriting the oldest recordings in the event of a lack of space on the carrier. The recordings are transferred only to entities authorized to gain access to such data on the basis of the provisions of law, including law enforcement authorities or entities whose participation in the implementation of the above-mentioned processing purposes is necessary, and which have been entrusted with the processing of data on the appropriate basis and to the appropriate extent – based on an appropriate request in this regard.
- The tracks are operated using Apex. All information regarding the privacy policy and the terms and conditions of online reservations can be found on the https://www.apex-timing.com/en/ website.
- Reservations – in order to confirm the reservation for organized groups, the Client pays 100% kwoty. Zadatek pozostaje bezzwrotny jeśli Klient odwoła rezerwacje w terminie późniejszym niż na 5 dni przed planowaną rezerwacją. Wpłacona przez Klienta kwota zostaje zaliczona na poczet ceny. Gdyby do wykonania usługi nie doszło z winy Klienta, to zadatek nie podlega zwrotowi.
- The Ticket may be returned at the ticket office of the given go-kart track on which the Service was to be performed in the following cases:
- in any case, provided that the Client, the Service Recipient performs this action no later than 5 days before the date of commencement of the provision of the Service, in accordance with the date indicated on the Order/Ticket, by handing over the Purchased Order/Ticket together with a fiscal receipt to the cashier;
- in any case where the possibility of fulfilling the Ticket/Order on a given day on a given track turns out to be impossible and the service is cancelled for this reason – within 14 days from the date of cancellation. In the event of closure of the go-kart track, the refund can be made within 14 days of its opening.
- By returning the Ticket, the Client, the Service Recipient has the right to receive a refund of the price shown on the Order.
- Online reservations are made in accordance with the online booking regulations, (Apex Timing Online Reservation System) located at the following link: https://kartcenter.pl/regulamin-rezerwacji-on-line/. Returns of Orders placed via the aforementioned Reservations are made in accordance with the principles set out in the aforementioned Regulations.
- Any complaints regarding the services provided on the go-kart tracks should be reported immediately to the Organizer or the shift manager present on the track at the time of filing the complaint. Any comments regarding the quality of services provided by the Organizer can be submitted by e-mail to info@kartcenter.pl. Responses to submitted complaints will be provided within 30 days.
